Selecting an Attorney

 

When selecting counsel to represent you in a potential qui tam action, you should consider several important factors.

Experience

Is the prospective counsel experienced in the field?  A critical step in every qui tam case is the decision by the Department of Justice on whether to join in the suit.  Is the attorney familiar with how the Government makes its decision and the factors they consider?  Does the attorney have government experience working on False Claims Act cases?

Track Record

Does the attorney you are considering have a record of success?  Have they successfully handled large complex cases against well-funded opponents?

Who will actually be your attorney?

Is the firm you are contacting simply an attorney referral service?  Who will do the day-to-day work on your case?  Are you dealing with the named partners or someone else?

What Are the Terms of the Fee Agreement?

Are you being offered a contingency agreement?  Who is going to cover the costs of the case?  Are you getting a fair deal?  Is the contingency percentage reasonable?
