Protection for Whistleblowers The False Claims Act contains provisions that specifically address concerns you may have about your job security in the event that you report fraud by your employer. If an employee is "discharged, demoted, suspended, threatened, harassed, or in any other manner discriminated against . . . by his or her employer because of lawful acts done by the employee . . . or others in furtherance of an action under [the whistle blower provisions of the False Claims Act], the employee will be entitled to all relief necessary to make the employee whole." The relief provided for under the Act includes reinstatement, double the amount of any lost back pay, interest on the back pay, and compensation for any special damages sustained as a result of the discrimination, including litigation costs and reasonable attorney's fees.
